In witness whereof, the Customer has caused this Agreement to be duly executed and delivered to Fusting Electric LLC (“Fusting Electric”) and agrees that the following terms and conditions shall apply to any invoice, estimate, quote or purchase order between Customer and Fusting Electric.
Fusting Electric Text Messaging Terms
When you provide a mobile telephone number and affirmatively consent to receive text messages, you agree to receive text messages from Fusting Electric LLC (“Fusting Electric”). Messages may concern responses to inquiries, estimates, scheduling, appointment reminders, service updates, invoices, payment-related notices, follow-ups, and customer support. Consent to receive text messages is not a condition of purchasing goods or services.
Message frequency varies depending on your requests, appointments, and services. Message and data rates may apply according to your mobile carrier and plan.
OPT-OUT: You may cancel text messages at any time by replying STOP. After you reply STOP, we may send one confirmation message, and you will no longer receive text messages from us unless you subsequently opt in again.

Mobile carriers are not responsible for delayed or undelivered messages. Our collection, use, and protection of personal information, including mobile telephone numbers and SMS consent, are governed by our Privacy Policy.
Warranty
- Fusting Electric provides a lifetime labor guarantee and a one-year materials warranty. All electrical work performed by Fusting Electric is guaranteed against workmanship defects for the lifetime of the installation, and all materials provided by Fusting Electric are warranted for one year from the date of completion. Should any issues arise, we will address and rectify any workmanship issues that arise at no additional cost.
- To make a warranty claim, please notify us within one year of the date on which Fusting Electric completed the services for materials claims, or at any time for workmanship issues, providing the necessary details and evidence of the issue. The warranty is non-transferable and applies only to the original customer. The warranty does not cover damage caused by external factors such as natural disasters, accidents, misuse, vandalism, or unauthorized modifications. Such warranty shall be void and of no effect if the equipment which is the subject of any services performed by Fusting Electric has been used or operated in any manner or in any environment not consistent with the intended purpose or modified or repaired in any manner. Fusting Electric’s sole obligation under such warranty shall be to make such changes and corrections with respect to its workmanship for the lifetime of the installation, and with respect to materials reported within one year of the date on which Fusting Electric completed such services.
- THE WARRANTIES AND REMEDIES SET FORTH IN THIS PARAGRAPH CONSTITUTE THE ONLY WARRANTIES WITH RESPECT TO ANY SERVICES OR WORK PERFORMED BY FUSTING ELECTRIC AND THE EXCLUSIVE REMEDIES IF SUCH WARRANTIES ARE BREACHED; AND SUCH WARRANTIES ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED AS TO ANY MATTER WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVEN IF FUSTING ELECTRIC HAS BEEN ADVISED AS TO THE POSSIBILITY OF SUCH DAMAGES.
General
- Please note that if unforeseen circumstances or additional requirements not previously discussed arise during your project, it could result in an adjustment to the final cost. Any deviations from the original scope of work will be communicated and agreed upon before proceeding.
- Unless otherwise stated on proposal/estimate/quote/bid/purchase order (“proposal”), if a proposal not accepted by Customer within 30 days, Fusting Electric reserves the right to review and/or reject proposal.
- Any modification of an accepted proposal must be mutually agreed upon. Modified agreements, additional maintenance, and/or monitoring contracts shall be subject to all terms and conditions as provided herein – except as the parties may otherwise agree in writing.
Payment
- The Customer agrees to pay Fusting Electric all fees for the Work and services as specified in all applicable purchase orders, estimates, quotes, written and verbal agreements. All monetary amounts used herein will be deemed to refer to current U.S. dollars. Pricing is contingent on site being accessible.
- If payment is not received by due date, Fusting Electric reserves the right to terminate or suspend Agreement, without limiting any other rights and remedies.
- For balances due over thirty (30) day, interest will be charged at the rate of three percent (3%) per month (or the maximum rate permitted by law, whichever is lower) and will be added to unpaid balances until payment is received by Fusting Electric.
- The Customer will pay on demand all of Fusting Electric’s reasonable attorney fees and other costs incurred by Fusting Electric to collect any fees or charges due Fusting Electric under Agreement following Customer’s breach.
Taxes
- Our fees, unless stated in writing otherwise, do not include any taxes, levies, duties or similar governmental assessments of any nature including but not limited to value added, sales, use or withholding taxes, accessible by any local, state, provincial, federal or foreign jurisdiction (collectively, “Taxes”). The customer responsible for paying all Taxes associated with the Customer’s purchases hereunder. If Fusting Electric has the legal obligation to pay or collect Taxes for which the customer is responsible under this paragraph, the appropriate amount will be invoiced to and paid by the customer, unless the customer provides a valid tax exemption certificate authorized by the appropriate taxing authority.
- Unless explicitly stated otherwise in writing, Proposal does not encompass permitting services. The Customer assumes full responsibility for obtaining all necessary permissions not expressly outlined in the proposal by Fusting Electric, including but not limited to HOA approval, landlord approval, building permits, applicable county permits, and property owner consent.”
Customer Responsibilities
- The Customer will be responsible for:
- giving Fusting Electric access to the premises for purposes of performing service;
- promptly rendering all decisions and approvals so as not to delay or impede the performance of work by Fusting Electric;
- promptly notifying Fusting Electric of any issues, concerns or disputes with respect to the work;
- any other item referenced in Agreement as being a matter of Customer’s responsibility.
- Customer acknowledges and agrees that Fusting Electric’s performance is dependent on Customer’s timely and effective satisfaction of its responsibilities under Agreement.
Liability Limitation
- Fusting Electric’s liability under agreement and any services provided, for any cause whatsoever, regardless of the form of action (whether in contract, in tort, including negligence, or otherwise), except for gross negligence or willful misconduct of Fusting Electric or its employees or agents, will be limited to general money damages (and no other relief) in an amount not to exceed the aggregate fees paid by customer for applicable service to which such liability relates. UNDER NO CIRCUMSTANCES WILL FUSTING ELECTRIC BE LIABLE FOR ANY LOSS OF PROFITS, ANY CLAIM OR DEMAND AGAINST CUSTOMER BY ANY OTHER PARTY, OR SPECIAL, CONSEQUENTIAL OR INDIRECT DAMAGES OF ANY KIND. No action, regardless of form, arising out of agreement may be brought by either party more than one year after the cause of action accrued.
Safety
- Fusting Electric shall take all precautions it deems reasonably necessary in its sole judgment for the safety of its employees or agents, and shall provide all reasonable protection necessary in its sole judgment to prevent damage, injury or loss by its employees or agents. Fusting electric shall provide such insurance certificates as are reasonably required by Customer.
Other Agreements
- Agreement (including all applicable estimates, quotes, purchase orders, written communication) constitutes the entire agreement among the parties and there are no other terms not contained herein. No variation, modification, amendment or waiver hereof shall be deemed valid unless in writing and signed by the parties herein. If any provision of Agreement is construed to be invalid, illegal or unenforceable, then the remaining provisions shall not be affected thereby and shall be enforceable without regard thereto. It is hereby acknowledged that all services performed by Fusting Electric for Customer are subject to Agreement.
Force Majeure
- Fusting Electric will not be responsible for delay of failure in performing services caused by acts of God, fire, explosion, governmental regulations or orders, pandemics, shutdowns, failure of transportation, failure or delay of suppliers, inability to obtain supplies or materials at a reasonable price, accidents, riots, war or other causes beyond its reasonable control.
Miscellaneous
- Except as expressly proved in Agreement, no failure to exercise, delay in exercising, or single or partial exercise of any right, power or remedy by either party shall preclude any other or further exercise of the same or any other right, power or remedy. Agreement shall be governed by and construed in accordance with the laws of the state where work is being performed. The parties hereby submit to the jurisdiction of, and waive any venue objections against, the federal and state courts in such state. EACH PARTY HEREBY WAIVES ANY RIGHT TO JURY TRIAL IN CONNECTION WITH ANY ACTION OR LITIGATION IN ANY WAY ARISING OUT OF OR RELATED TO AGREEMENT. Agreement does not create a partnership, franchise, joint venture, agency, fiduciary or employment relationship between the parties. Agreement is entered into by and between, and may be enforced only by, the parties and Agreement will not be deemed to create any rights in third parties. Except as otherwise expressly provided herein, all remedies provided for in Agreement will be cumulative and in addition to and not in lieu of any other remedies available to either party at law or in equity. Headings used in Agreement are for convenience only and will not be deemed to be operative text.
